What Are the Rental Laws in Pacific Grove?

Pacific Grove has one of the strictest short-term rental (STR) permit systems on the Monterey Peninsula, requires a business license for all rental property owners regardless of tenancy length, and enforces both aggressively. Long-term rentals (leases of 30 days or more) are permitted with business license. Vacation rentals (under 30 days) require a specific STR permit, which is capped in number and generally not available to new applicants. All Pacific Grove rentals are subject to California state landlord-tenant law including AB 1482 rent caps and just cause requirements after 12 months of tenancy.

What follows is a comprehensive guide to Pacific Grove-specific rental requirements as of 2026, along with California state requirements that apply.


The Business License Requirement

Every Pacific Grove rental property owner must hold a current business license from the City of Pacific Grove.

Requirements: - Application through City Clerk - Annual renewal - Fees typically under $200/year - Required for both long-term and short-term rentals

Enforcement: Pacific Grove actively enforces business license requirements. Discovery of unlicensed rental activity results in back-fees, penalties, and potentially fines.

Short-Term Rental Permits

Pacific Grove operates a capped STR permit system that materially affects rental strategy.

Key points:

Capped number. The city limits total active STR permits. Waitlist for new permits is typically long.

Definition of STR. Rentals of less than 30 days require STR permit.

Long-term rentals exempt. Leases of 30+ days do not require STR permit (but still require business license).

Transfer rules. Permits are transferable in limited circumstances (typically with property sale within specified time).

Enforcement. Very active. Dedicated staff for STR enforcement. Substantial fines for unpermitted operation.

Zoning: Not all Pacific Grove zones eligible for STR permits.

Transient Occupancy Tax

For STRs (stays under 30 days), transient occupancy tax applies:

Rate: Typically 10 to 12% Collection: From guest, remitted by owner or platform Filing: Regular remittances required

For rentals of 30+ days, TOT does not apply.

California State Rental Laws Applicable in Pacific Grove

Beyond city-specific rules, California state laws apply:

AB 1482 Rent Cap

Applies to most Pacific Grove residential rentals.

  • 5% + regional CPI, max 10% annually

  • 90-day notice for increases >10% (only available for exempt properties)

Security Deposits (AB 12)

Effective July 2024: - One month's rent maximum for most owners - Two months allowed only for small landlords with ≤2 properties/4 units (with limits) - Must be held in trust - 21-day return process required

Fair Housing

California fair housing law prohibits discrimination based on: - Race, color, religion, sex, familial status, disability, national origin, ancestry - Age - Marital status - Sexual orientation, gender identity - Source of income (including Section 8 vouchers) - Genetic information - Immigration status - Military/veteran status

Screening must be consistent and documented.

Habitability

California Civil Code 1941 requires landlords to maintain habitability including: - Structural integrity - Working plumbing, electrical, heating - Weatherproofing - Working locks - Safety systems

Notice Requirements

For rent increases, termination, entry, and other landlord actions: - Written notice required - Specific timelines and content per statute - Proper service (personal delivery, substituted, or posting)


Practical Strategy for Pacific Grove Owners

Given the regulatory environment, most Pacific Grove rental strategies fall into these categories:

Long-term unfurnished (12+ months)

  • Requires business license
  • Subject to AB 1482 rent cap (unless exempt)
