Do I Need a Rental License or Permit in Monterey County?

Most Monterey Peninsula cities require some form of business license, rental registration, or permit for residential rental properties. Requirements vary significantly by city, and short-term vacation rentals face substantially stricter permit requirements than long-term rentals. Failing to register or obtain required permits creates fines and can create complications during eventual property sale.

What follows is a city-by-city summary of rental licensing requirements on the Monterey Peninsula as of 2026. Always verify current requirements with the applicable city or county before relying on this information, as ordinances change.


City of Carmel-by-the-Sea

Business License: Required for residential rental property owners.

Short-Term Rental Permits: STRs (stays under 30 days) are largely prohibited in Carmel-by-the-Sea. Very limited exceptions exist. Long-term rentals (30+ days) are permitted with business license.

Registration Process: Business license application through city clerk. Annual renewal required.

Fees: Modest annual fees, typically under $200/year.

Enforcement: Active enforcement on unpermitted STRs. Fines are significant.

Practical for owners: Long-term rentals are straightforward. STRs are effectively unavailable. Business license is required regardless.


City of Pacific Grove

Business License: Required for rental property owners.

Short-Term Rental Permits: Pacific Grove operates a capped STR permit system. New permits are difficult to obtain (limited number, waitlist). Existing permits are transferable in limited circumstances.

Registration Process: Business license application. STR permit application separate if applicable.

Fees: Business license typically under $200/year. STR permit fees higher.

Enforcement: Very active. Dedicated staff for STR enforcement.

Practical for owners: Long-term rentals require business license only. STR strategy generally not available without existing permit. Furnished 30-day+ rentals do not require STR permit but do require business license.


City of Monterey

Business License: Required for rental property owners.

Short-Term Rental Permits: Monterey restricts STRs with a permit system. Not all zones eligible.

Registration Process: Business license through city. STR permit application separate.

Fees: Business license annual fee. STR permit additional if applicable.

Enforcement: Active enforcement.

Practical for owners: Long-term rentals require business license. STR limited to permit holders in permitted zones.


City of Seaside

Business License: Required for rental property owners.

Short-Term Rental Permits: Restrictions in place. Verify current requirements.

Registration Process: Business license through city.

Fees: Annual business license fees.

Enforcement: Active.

Practical for owners: Business license required. Long-term rentals generally straightforward.


City of Marina

Business License: Required for rental property owners.

Short-Term Rental Permits: Verify current requirements.

Registration Process: Business license through city.

Fees: Annual fees.

Practical for owners: Business license required. Verify current STR rules if applicable.


City of Del Rey Oaks and Sand City

Smaller cities with specific requirements. Verify with each city directly.


Unincorporated Monterey County

For properties in Pebble Beach, Carmel Highlands, Carmel Valley (unincorporated areas), and other unincorporated parts of Monterey County:

Business License: May be required. Verify with Monterey County.

Short-Term Rental Permits: Monterey County has its own STR permit framework for unincorporated areas.

Registration Process: Through Monterey County departments.

Fees: Vary by application.

Enforcement: Active for STR compliance.

Practical for owners: Requirements different from city-based rentals. Verify specifically for your property's jurisdiction.

Common Compliance Errors

Assuming no license needed for short-term or occasional rental. Even occasional rental activity often triggers business license requirements.

Missing renewal deadlines. Business licenses are typically annual. Missed renewals create back-fees and compliance gaps.

Not registering STRs. Unpermitted STRs are aggressively enforced on the Peninsula, with substantial fines.

Assuming Monterey County = City of Monterey. These are different jurisdictions with different rules. Verify which applies to your specific property.

Not updating registration for ownership changes. New owners should update business licenses within timeframes required by each jurisdiction.

Ignoring HOA requirements. In addition to city requirements, HOAs may have their own rental restrictions or registration requirements.


What Happens If You Don't Have Required Licensing

Consequences of non-compliance:

Fines. Cities impose fines for operating without required licenses. These accumulate over time.

Back-fees at discovery. When discovered, cities typically require payment of back-license fees plus penalties.

STR-specific penalties. Unpermitted STR operation can result in substantial per-day fines.

Sale complications. Some jurisdictions require permit clearance for property sale. Non-compliance can delay or complicate sale.

Insurance issues. Some policies require compliance with local ordinances. Non-compliance may affect coverage.

HOA disputes. HOA rental restrictions may create separate compliance issues.

The cost of proper licensing is minimal ($100 to $500/year in most cases). The cost of non-compliance can be substantial.


Transient Occupancy Tax (TOT)

For short-term rentals, transient occupancy tax typically applies. This is a percentage of rental revenue paid to the applicable city or county.

Rates: Vary by jurisdiction, typically 10 to 12% on the Peninsula.

Collection: Usually collected from guest and remitted by owner (or platform for airbnb/VRBO stays).

Filing: Regular filings required (monthly or quarterly depending on jurisdiction).

Penalties: Non-compliance creates significant back-tax and penalty exposure.

For rentals of 30 days or more, TOT typically does not apply. This is one reason furnished 30-day+ rentals are a common strategy on the Peninsula.


Property Manager Coordination

Property managers typically coordinate licensing requirements for owners as part of onboarding. This includes:

  • Verification of current registration status
  • Application for missing business licenses
  • Ongoing renewal management
  • Coordination of STR permits where applicable
  • TOT collection and remittance for STRs

This coordination is included in standard management fees and eliminates a significant administrative burden for owners, particularly out-of-state owners.


What to Verify Before Renting Out

If you are preparing to rent out a Peninsula property, verify:

  1. Applicable jurisdiction. City or unincorporated county.
  2. Business license requirement. Application process and fee.
  3. STR permit status if applicable. Availability, application process.
  4. HOA restrictions if applicable. Rental rules, minimum lease terms.
  5. Zoning compliance. Some properties have zoning restrictions on rental use.
  6. Insurance requirements. Some carriers require local compliance.
  7. Tax obligations. TOT for STRs, income tax for all rentals.

This verification is typically part of the pre-listing preparation. Skipping it creates avoidable exposure.
